TERMS AND CONDITIONS


This Wi-Fi Service (the “Service” or “Wi-Fi Service”) is provided by TraxComm Limited. The use of the Service is governed by and subject to the Terms and Conditions contained herein and the Disclaimers and the Personal Information Collection Statement (“PICS”) annexed hereto.

  1. The use of the Service is limited to a maximum of 4 sessions each of 30 minutes per day (from 00:00 to 23:59) per device (with compatible Wi-Fi function) at Hong Kong West Kowloon Station.
  2. Some mobile devices will automatically switch from Wi-Fi to mobile data connectivity under some circumstances. To avoid the device from auto-switching to mobile data connectivity, you should switch off the mobile data and data roaming function before using the Service. You should then enable the Wi-Fi function on your device and select “MTR Free Wi-Fi” as the SSID and you will be redirected to the Service login page automatically. For some devices, you may be required to launch your Internet browser and type any URL into the address field right after the SSID is selected in order to be redirected to the Service login page.
  3. You may not be able to use the Wi-Fi Service if your connected device (such as smartphone or PC) is not IEEE 802.11 a/b/g/n Wi-Fi compatible.
  4. You shall not distribute Internet Viruses, Trojan Horses, or other destructive software, or engage in any illegal activity through our Wi-Fi network.
  5. You shall not cause any inconvenience or annoyance to any other persons when using the Service.
  6. You shall comply with all applicable laws, ordinances, regulations, bylaws, rules and orders of Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”) and follow the instructions given by TraxComm Limited from time to time.
  7. You shall fully indemnify and keep indemnified TraxComm Limited, its officers, directors, employees, contractors, agents, representatives, parent companies, affiliates and associates against all claims, demands, damages, costs (including legal costs) and expenses arising out of any claims, awards, proceedings or actions arising out of and/or in relation to your use of the Service.
  8. TraxComm Limited shall have the right to deny, restrict or suspend your use or access to the Wi-Fi Service at its absolute discretion without notice.
  9. TraxComm Limited reserves the rights to amend these Terms and Conditions, the Disclaimers and/or the PICS at any time without prior notice. In case of any disputes, TraxComm Limited’s decision shall be final and binding.
  10. These Terms and Conditions, the Disclaimer and the PICS shall be governed by, and construed in accordance with, the laws of Hong Kong and you and TraxComm Limited hereby agree to submit to the exclusive jurisdiction of the courts of Hong Kong.
  11. These Terms and Conditions, the Disclaimers and the PICS have been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
  12. By pressing the “Agree and Connect” button, you confirmed that you have read and understood and agreed to all these Terms and Conditions, the Disclaimers and the PICS. Otherwise, you shall not proceed to log on to and use the Service.
  13. The parties to this agreement do not intend that any term of this agreement should be enforceable, by virtue of the Contracts (Rights of Third Parties) Ordinance, by any entity or person who is not a party to this agreement.
